ENDORSEMENT FORM 100

Provides lender with affirmative insurance concerning covenants, conditions and restrictions, encroachments, easements, and mineral development.


Endorsement Form 100 when attached to an ALTA Loan Policy, additionally provides the lender with specific insurance against the following:

(1) That no covenants, conditions or restrictions exist under which the lien of the insured mortgage can be cut off subordinated or otherwise impaired.
(2) That no present violations of enforceable covenants, conditions or restrictions exist.
(3) That there are no buildings, structures or improvements primarily located on the mortgaged property which encroach onto adjoining lands.
(4) That there are no buildings, structures or improvements primarily located on adjoining lands which encroach upon the mortgaged property.
(5) That there is no loss through damage to existing improvements which are located or encroach upon a portion of the land subject to any easement shown in Schedule B, which damage results from the exercise or maintenance of the easement facility.
(6) That no loss through damage to existing improvements resulting from the exercise of a right of surface entry for the extraction or development of the minerals (including oil and gas) either excepted from the Schedule A description or shown as a reservation in Schedule B.
(7) Any final court order or judgment requiring removal from any land adjoining the mortgage property of any encroachment onto such adjoining land shown in Schedule B.
